WHO WE ARE
Showsintheus.com is a website (“Site”) designed to connect venues, bands and artists in general with the public at large about all events of interest in their community.
1 / GENERAL INFORMATION
Are There Fees For Using This Service?: You can access to Showsintheus.com or any other sub websites (listed at the bottom of this page) at anytime. You don't need to be a member to check all the listings. To get information, reminders and other messages, you must subscribe to Showsintheus.com. All subscriptions are Free. After the registration, you have access to your own “profile page”.
User name and Create a Password: You will need to create a user name (login id) and a password if you are a new user. Your password must be between 6 and 20 characters long and may not include spaces. All characters should be alphanumeric (a,b,c,1,2,3). After validation, you are can access to your page at anytime.
Changing and Updating Personal Information; Choosing Options: Subscribers can change all of their personal account information by going to http://www.showsintheus.com and clicking the "My Account" button. You can change your address, telephone number, email address, as well as your privacy settings (login id and password).
Illegal Activity: You agree not to use this Site for unlawful purposes or in an unlawful manner. You agree to comply with all applicable local, state, federal and international laws, statutes and regulations regarding the use of the Site. You agree not to use or permit anyone to use information provided through the Site for any unlawful or unauthorized purpose. You agree not to register under a false name or use an invalid or unauthorized credit card.
What is your Billing Address?: IMPORTANT: Please enter the address where your credit card statement is sent. A PO Box can be entered as a valid Billing Address.
Special Offers, Updates and Newsletter: Established members will occasionally receive information on products, services, special offers, and a newsletter (only through “my message” area). Out of respect for the privacy of our users we offer the option to not receive these types of communications.
Customer Service: We communicate with users on a regular basis to provide requested services. We respond to issues relating to a user's account via messages, ONLY. On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance we might send users a message. Generally, users may not opt-out of these communications. However, these communications are not promotional in nature.
2 / PURCHASING TICKETS AND OTHER IMPORTANT INFORMATION
General: To purchase tickets you must be 18 or older. Showsintheus.com accepts two major credit cards: Visa, MasterCard. You should ALWAYS check with the venue, club or artist the exact date and time, location, line up etc... Showsintheus.com is not responsible for any wrong, misprint, false information, postings on the website. If you buy tickets through showsintheus.com website, you need a printer to print ticket(s). Venues or business can sell their ticket(s) through links to different websites. Please be aware that Showsintheus.com exercises no control over linked sites and is not responsible for the privacy practices or the content of such sites. Each linked site maintains its own independent privacy and data collection policies and procedures, and you are encouraged to view the privacy policies of these other sites before providing any personal information to them.
How it works: Only members can buy tickets. To become a member, you have to subscribe to Showsintheus.com: it’s free! When you become a member, you will receive a number of messages throughout the transaction process. Your invoice(s) is in the “Message” section. Your ticket(s) purchased is in the “Ticket” section. All messages go through your personal page and NOT your regular email. To validate a transaction, the buyer has to assign different name for each ticket purchased (3 tickets = 3 different names, for example). After validation of the transaction, the buyer can not change the name(s) on those ticket(s). The buyer gets 1 message in his personal page: Ticket section. (Example: 3 messages contains 3 tickets = 3 pages = 3 different names). The buyer has to print the message(s) to get a ticket(s). To access to the venue, the buyer or the holder must bring those “print ticket(s)” to the venue box office. The venue will ask each person an ID to verify and match the tickets the buyer purchased and the list of name in their file. The “person name” is the person(s) who’s going to show. If the buyer did not get the message with the ticket purchased in his ticket section, he needs to contact customer service as soon as possible. Be aware, each seller (venue, promoter, security and event staff) has their own regulations (rules) to access the venue (your id or credit card required, etc..- check the venue listing for details, or the venue website). Your admission can be refuse if you don’t comply to those regulations.
Mistake in the “person name” or want to switch to another person after your purchase: Because you can not change any name(s) in the actual “print ticket”, you, the buyer and only the buyer, need to contact via message the promoter or the venue with: the date of the purchase, the time, the authorization, the name of the buyer, the “person name” you want to change, and the new name. Change “person name” must be requested no later than 48 hours before the show is schedule. NO EXCEPTION.Currency: All ticket prices for events that occur in the United States are stated in U.S. Dollars (“USD”).
Permission and Payment Methods: You grant Showsintheus.com permission to charge your credit card for the purchase of items (as a Buyer).
Ticket Information: Event dates, times, line up, venues and other subject matter, which are listed on the ticket you received through your message account at Showsintheus.com, may change. It is up to you, the Buyer, to verify the most recent changes. Please check the venue on Showsintheus.com or refer to local listings for any changes.
Purchase ticket(s): As Showsintheus.com handles your transaction and offers a 100% Buyer Guarantee, there is a fee on each ticket sold in addition to the listing ticket price. All fees are shown on the final step of the purchase process for you to verify before confirming your purchase. Please keep in mind that, upon completing your purchase, ALL PURCHASES ARE FINAL. Showsintheus.com requires a credit card in order to verify each buyer's identity and to protect our sellers against fraudulent purchases. For security purposes, we don't allow you to save your credit card number on your profile page.
Order Confirmation: If you do not receive a confirmation number (in the form of a confirmation page in your message area) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with our Customer Service Department whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process, Showsintheus.com will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
Pricing and Availability: Showsintheus.com only sells tickets on behalf of venues, which means Showsintheus.com does not set the ticket prices or determine seating locations. Showsintheus.com does not control this inventory or its availability. All tickets sold through our Site can't be resold.
Substituted Seat Locations: Ticket listings are a representation of actual seat location. Tickets may be substituted with comparable or better seat locations. Actual seat and row numbers may vary from those purchased on the Site.
Refund policy: No refunds, no cancellations, no credits, no exchanges, and no transfers after the order has been made. Unless the event is canceled or rescheduled, there are no refunds. If the event is canceled you will receive a refund for the face value of the ticket - fees are not refundable. If the event is postponed (a) the ticket(s) will be honored for the rescheduled date (b) you can request a refund for the face value of the ticket(s) - fees are not refundable. ALL refunds request must be made within 5 days of the event's originally scheduled date. To request a refund you must forward your original message (receipt(s)) to the customer service – failure to do so will waive your right to a refund. Unforeseen circumstances beyond Showsintheus.com control will not be grounds for a refund, including but not limited to the following: local or national weather conditions and natural disasters, waiting in lines, family and medical emergencies. Promoters, venues, security and event staff have the right to refuse entry to any ticket holder, without a refund, for any reason at their discretion, including but limited to: disorderly behavior, intoxication, venue capacity, breach of security restrictions, riot or fights, venue shut down the night of the show.
Release: We are not involved in the actual transactions between Buyers and Sellers. If you have a dispute with one or more members, you fully and irrevocably release Showsintheus.com and all affiliated companies, officers, directors, agents, attorneys, parents, subsidiaries, legal representatives and employees from and against any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such dispute. You acknowledge that California Civil Code Section 1542 provides: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." If you are a resident of California, you agree to waive California Civil Code Section 1542. If you are a resident of any other state or foreign country, you agree to waive in advance any similar laws of such other jurisdiction.
Sharing Information: At Showsintheus.com, we care about your privacy. We will not share your credit card number or any other financial information with any third party except for the verification purposes mentioned above. We may share your personal information with third parties in the following instances:Legal Disclaimer: Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law if we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Site. We may disclose personal information in order to establish or exercise our legal rights or defend against legal claims. We also share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law.Aggregate Information (non-personally identifiable): We share some aggregated demographic information (profile, zip codes) with some of our partners. This is not linked to any personally identifiable information. We may use third-party advertising companies to promote ads on our behalf. These companies may employ cookies and action tags (also known as single pixel gifs or web beacons) to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous.Co-Branded Partners: The contact information and transaction data (excluding credit card numbers) provided by customers on our co-branded sites and registered or transacted through a partner's co-branded Showsintheus.com are essentially shared with the owner of that co-branded website. Your choices about being contacted are included with that information so that partner can respect your preferences. Refer to that website's privacy policy for information on how they will handle your information.Third Party Service Providers: We may disclose information about individual users to third parties who provide services to Showsintheus.com. These third parties provide a variety of services to Showsintheus.com, including, without limitation, processing credit card transactions, and disbursing payments to Sellers. In addition, these services may include exchanging the information Showsintheus.com collects about its customers. We may also use third-party email providers to assist with sending our marketing emails. These companies do not retain, share, store or use personally identifiable information for any secondary purposes. Any personally identifiable information that Showsintheus.com shares with its service providers may only be used to provide services to Showsintheus.com and the service providers will not be given permission to use such information for any other purposes.

Supplementing Information: In order for this Site to properly fulfill its obligation to protect all of its users, it is necessary for us to verify your credit card information with a third party. Currently we use Authorized.net, but we reserve the right to change verification agents if we deem it necessary. We collect credit card information for verification purposes only; we do not store your credit card information with your profile other than that your credit card has been verified.
Profile: We store information that we collect through cookies and log files to create a profile of our users. A profile is stored information that we keep on individual users which details their preferences. Consequently, collected information is tied to the user’s personally identifiable information to provide offers and improve the content of the Site for the user. This profile is used to tailor a user's visit to our site, and to direct pertinent marketing promotions to them. This information may also be used to help improve our services overall. We do not link the information we store in cookies to any personally identifiable information you submit while on our Site.
Cookies: A cookie is a piece of data stored on the user's computer tied to information about the user. Usage of a cookie is not linked to any personally identifiable information while a user is visiting our Site. We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user's hard drive for an extended period of time. Persistent cookies enable us to track and target the interests of our users to enhance their experience on our Site. By setting a cookie on our Site, users would not have to log in a password more than once, thereby saving time while on our Site. If users reject the cookie, they may still browse our Site, however they will not be able to buy or sell tickets. Persistent cookies can be removed by following Internet browser help file directions.
Log Files: Like most standard Web site servers, we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring pages, platform type, and date/time stamp. IP addresses are linked to personally identifiable information. We use Log Files in error diagnostics, session management and determining our advertising efficacy.
Business Transitions: In the event Showsintheus.com goes through a business transition, such as a merger, an acquisition by another company, or a sale of all or a portion of its assets, users' personal information will, in most instances, be part of the assets transferred. Users will be notified via prominent notice on our Site for a period of 30 days following a change of ownership or control of their personal information, if personal information will be used contrary to this policy. If as a result of the business transition, the users' personally identifiable information will be used in a manner different from that stated at the time of initial collection, users will be given the option to continue sharing their information consistent with our notification of changes section. However, nothing in this Privacy Policy is intended to interfere with the ability of Showsintheus.com to transfer all or part of its business and/or assets (including the Site), for any purposes, without any limitation whatsoever. Showsintheus.com specifically reserves the right to transfer or share a copy of personally identifiable information collected from its Site to the buyer of that portion of its business relating to that information.
Security: This Site takes every reasonable precaution to protect our users' information. When users submit sensitive information via the Site, their information is protected both online and off-line.When our registration/order form asks users to enter sensitive information (such as credit card number), that information is encrypted and is protected with encryption software, currently SSL encryption. While on a secure page, such as our order form, the lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when users are just 'surfing'. While we use SSL encryption to protect sensitive information online, we also protect user-information off-line. Access to all users' information, not just the sensitive information mentioned above, is restricted to our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. Employees are kept up-to-date on our security and privacy practices. The servers that store personally identifiable information are in a secure environment, behind a locked cage at a professional hosting company. Although we endeavor to create secure and reliable Sites and to safeguard against unauthorized disclosures of information, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this Privacy Policy. You hereby acknowledge that Showsintheus.com is not responsible for any intercepted information sent via the Internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.
